The nonrefundable payment to hold is placed to hold a particular cat/kitten for a buyer. ALL PAYMENTS TO HOLD ARE NONREFUNDABLE. Our cattery's goal is to place our cats/kittens in loving homes in a timely manner so they may bond with their new family. If a cat/kitten is held specifically for a buyer, a change of mind can quite often jeopardize the chance for that cat/kitten to be placed in a home while still at a desirable age.
The Breeder Guarantees that the cat/kittens described above are pure bred Maine Coon as described with an accurate pedigree (certified pedigree available from TICA) and eligible for registration in TICA(The International Cat Association).
All kittens bred and sold have been examined by a licensed veterinarian and prior to sale and are guaranteed to be sound and in good health at this time. Vet documentation is provided.
All of our Maine Coon cats are tested for HCM (Hypertrophic cardiomyopathy), PKD (Erythrocyte Pyruvate Kinase Deficiency) and Spinal Muscular Atrophy (SMA).
We DO NOT allow DE-CLAWING of said kitten/cat. De-clawing is mutilation and cruelty that is likely to alter the kitten’s temperament and can cause poor litter box habits. Instead of de-clawing, the Buyer agrees to keep the kitten/cat toenails trimmed regularly and supply proper scratching material and training. If Buyer chooses to de-claw the kitten/cat, this contract is NULL and VOID.
The Buyer accepts the responsibility of caring for this kitten/cat for its entire natural lifespan and will provide properly for its welfare.
If at any time the kitten is transferred, sold, bred or given to another party this guarantee becomes void.
There is no guarantee on color, size or temperament.
The Buyer agrees to keep the kitten/cat in a clean and pleasant environment. The kitten/cat will not be confined to a cage for extended period of time. The kitten/cat shall have proper nutrition, health care, toys and companionship.
The Buyer agrees that under No circumstances will this kitten/cat ever be sold, leased or given to any pet store humane society, research or similar facility. It is the intention of the Breeder that the Buyer be a permanent placement home. Buyer must contact the Breeder immediately to return the animal without refund of purchase price; at any time they are no longer able to properly care for kitten.
The Buyer agrees that if the kitten is found to be neglected or mistreated: The Breeder shall have the unconditional right to reclaim the kitten WITHOUT refund of purchase price. Mistreatment shall include but is not limited to lack of proper food, water, being caged for excessive amount of time, poor health and otherwise poor condition.
The Buyer promises and warrants that the kitten will be an indoor animal, not allowed to roam freely outside. The Buyer agrees to keep cat/kitten’s vaccines up to date and will always receive proper medical care from reputable licensed veterinarian.
Breeder warrants that Kitten is sold in good health at the time Kitten leaves Breeder. Breeder further warrants that kitten has undergone a physical exam by Breeders veterinarian and found fit for sale. Stress in kittens can cause things such as sneezing or mild discharge from the eyes or nose and diarrhea. It’s important to always monitor kittens for first 72 hours to make sure they are eating/drinking. At any time, symptoms become worse you should contact your veterinarian.
Kitten must be examined by a licensed veterinarian within 48 hours (excluding Sunday) for health guarantee to remain valid. Failure to do so voids this guarantee. Buyer must provide Seller with the exam report within 2 days following examination. Report can be sent via email or text message to the information on the contract. If the kitten is found to be medically deficient with an untreatable or life-threatening problem, it must be reported to the Seller immediately along with veterinarians’ findings. Please allow 24 hours for our veterinarian to review findings. If confirmed, the kitten must be returned with all paperwork (or transport scheduled) within 3 days. At that time the kitten will be replaced with another cat/kitten of equal value as soon as a replacement is available. No cash refunds. All veterinary expenses and return shipping related expenses are the responsibility of the Buyer. If the Buyer decides to keep the kitten after confirmed diagnoses this guarantee becomes void and no replacement will be offered in the future.
Seller assumes no liability or responsibility for any veterinary care for this kitten after the Buyer takes possession of said kitten. Under no circumstances will the Seller be responsible for any veterinary bills incurred by the Buyer including ER visits or surgery.
The cat/kitten cannot be returned if it has been exposed to another cat that has not currently tested for FeLV and FIV.
There are no guarantees against FIP. It is the responsibility of the Buyer to provide immediate veterinary care to any cat/kitten showing signs of illness or distress and failure to do so will render any guarantee null and void.
This guarantee does not cover the death of a kitten from FIP, a mutated form of the Feline coronavirus, if said kitten dies of FIP it will not be replaced. We have no control over this virus.
The purchaser agrees never to vaccinate this kitten against FIP (Feline Infectious Peritonitis). The effectiveness of the vaccine has not been established, and the vaccine can cause the disease. Failure to comply will void guarantee.
This health contract does not cover coccidia or giardia. When a kitten enters a new home stress can cause GI upset resulting in diarrhea and loose stools which can be a result of coccidia/giardia. Giardia is a protozoan and can lay dormant in the intestinal tract, fecals can be negative and stools solid then the kitten becomes stressed due to new home environment, car ride, transport, etc and those that were dormant in the tract become active. Treatment does not kill anything dormant unfortunately. So as much as we would love to say that the kitten will not develop either when leaving we cannot. All our kittens and parents are dewormed regularly and have fecals done. IF the kitten does develop coccidia/giardia it is extremely important to start treatment immediately.
The cat/kitten is guaranteed against congenital defects and HCM for the first 12 months. Should the cat die as a direct result of a congenital defect or HCM, the cat will be replaced ONLY with one upon availability.
Purchaser must provide the veterinarian or specialist’s written report,
confirming, in writing, that in their opinion, the Kitten has a congenital defect. Further, should Kitten die
during this period as a direct result of a congenital defect (said congenital defect must be confirmed by two
independent veterinarians, in writing), Seller shall, replace Kitten with another of like kind and quality
only if an appropriate necropsy is performed by a licensed veterinarian and a veterinarian’s
certificate showing the congenital defect being the direct result of the cause of death is produced. All
veterinary expenses and return shipping-related expenses are the responsibility of the Purchaser.
Multi-cat households: Seller’s guarantee only covers the health of the Kitten. If Purchaser has a multi-cat /
multi-pet household, and your other pets come down with health issues after Kitten is introduced, Seller, is not
responsible for any veterinary expenses for your other feline(s) and pets, as we are not responsible for their
health. Similarly, if Kitten comes down with health issue(s) after its introduction to the multi-pet household,
we will be responsible only if your vet certifies, in writing, that Kitten’s health issues are congenital issues.
The purchaser’s responsibility is to ensure that existing felines are up to date on all vaccinations and have been
regularly checked by your veterinarian before introducing them to Kitten. It is the Purchaser’s responsibility to
quarantine Kitten for fourteen (14) days of receiving the Kitten if Kitten is going to a multi-pet household.
Unless otherwise agreed to by the Seller, in writing, this provision of isolating the Kitten for at least 14 days is
a strict requirement and Purchaser will void all health guarantees under this contract if the Kitten is not
isolated for at least 14 days.
Buyer agrees to keep cat/kitten on the recommended food choice for the first 2 months to avoid any new and/or abrupt transitions in diet.
All kittens sold to pet homes must be spayed/neutered by the time they are. 9m old or as directed by their veterinarian. TICA pet papers will be released with proof of sterilization. Documentation must accurately display identifier associated with kitten via microchip.
Any dispute or litigation concerning the heath guarantee that cannot be settled by both parties, must be settled in Falls County Texas. This is a legally binding document.
